Visitation Rights

Child custody and visitation rights may be a major source of conflict in any divorce. With sole physical and legal custody of a child, the custodial parent makes all decisions regarding the child's welfare but the non-custodial parent still may have visitation rights.  Once child custody is determined by the court, a visitation schedule by the non-custodial parent may be set up.

Often a court will order "reasonable" visitation rights, letting the parents work out a schedule. This allows the parents to take into consideration both their schedules and the children's. Sometimes courts will set up a fixed visitation schedule which includes the times and places of visitation for the non-custodial parent. This type of schedule allows predictability for the child and prevents one parent from controlling the other's time and opportunity to see the child.    

Grandparents of children of divorced parents may also petition courts for visitation rights. Grandparents may have to prove to the court, however, that harm may come to the grandchild if he or she is not allowed to be visited by the grandparents.
