Maryland Divorce
Per Maryland land, grounds for divorce include adultery, desertion, voluntary separation, conviction of a felony or misdemeanor if the defendant has been sentenced to serve at least 3 years and has served 12 months of the sentence, a 2-year separation, insanity, cruelty, or excessively vicious conduct. Cruelty or vicious conduct means that abuse has occurred against one of the parties or a minor child. Not speaking to one another is not considered abuse.
Maryland Legal Separation
A legal separation is a document signed by the separating parties which is a separation agreement. In it, such issues as marital property rights, spousal support, child support and other issues are settled between them. However, the parties will still need to file for a divorce if there is no hope of reconciliation. A Howard County family lawyer at our firm can provide the assistance you need with such a document.
Maryland Annulment
An annulment establishes that your marriage never existed in the first place. This is a relatively rare special action. The court must be presented with facts which allow it to grant an annulment. Proving such facts is often difficult. Courts are more likely to grant a divorce than an annulment. Contact a Howard County family law attorney at our firm to determine if you have grounds for an annulment.
